Is There Asbestos in Your Harlem Building?
Harlem's pre-WWII brownstones and tenements — most built between 1890 and 1940 — were constructed before asbestos regulations existed. Common locations include:
- Plaster walls and ceilings in pre-war brownstones (asbestos was a common plaster additive through the 1940s)
- Floor tiles and black mastic adhesive beneath linoleum in tenement apartments
- Pipe and boiler insulation in basement mechanical rooms and steam-heat risers
- Roof felt and built-up roofing systems on low-slope brownstone rooftops
- Window glazing compound and caulking around original wood-frame windows
- Textured ceiling finishes (cottage cheese or spray-applied) in post-war gut renovations through the 1970s
Asbestos Removal Costs in Harlem (2026)
Manhattan costs are among the highest in the country due to building access constraints, union labor requirements, and NYC DEP permitting fees. Ranges below reflect licensed contractor quotes for Harlem properties.
Harlem Asbestos Regulations
Four layers of regulation apply to asbestos work in Harlem — federal, state, OSHA, and New York City.
Federal EPA NESHAP
The National Emission Standards for Hazardous Air Pollutants require written notification to the EPA at least 10 working days before any regulated demolition or renovation. Applies to all building types with regulated asbestos-containing material (RACM).
40 CFR Part 61 Subpart MNY State Licensing — NY DOL ACB
New York Labor Law §902 and 12 NYCRR Part 56 require all asbestos contractors and handlers to be certified by the NY Department of Labor Asbestos Control Bureau. Any building with more than 4 dwelling units is considered a public building under state law.
NY Labor Law §902 / 12 NYCRR Part 56OSHA Worker Protection
Workers must use supplied-air respirators or P100 half-masks, wear full-body disposable suits, and undergo medical surveillance. The permissible exposure limit is 0.1 f/cc as an 8-hour TWA.
29 CFR 1926.1101NYC DEP — Local Law 76 / ACP-5 & ACP-7
Before any NYC building permit is issued for renovation or demolition, the property owner must file either an ACP-5 (certifying no asbestos hazard) or an ACP-7 (asbestos abatement project plan) with the NYC Department of Environmental Protection. No permit is issued without it.

ACP-5 Survey by a Certified Investigator
A NY DOL-certified asbestos investigator conducts a full building survey and collects bulk samples. The written report determines whether an ACP-5 (no hazard) or ACP-7 (abatement required) must be filed with NYC DEP before permits can be pulled.
ACP-7 Filing & 10-Day EPA Notification
If abatement is required, your NY DOL ACB-certified contractor files the ACP-7 with NYC DEP and submits the required 10-working-day advance notification to the EPA. Work cannot begin until both filings are acknowledged.
Containment & Negative Air Pressure Setup
Workers seal affected areas with 6-mil polyethylene sheeting and establish negative air pressure using HEPA-filtered air machines. In occupied multi-unit buildings, adjacent units must be notified and may need to be vacated.
Abatement & Waste Disposal
Materials are wetted, removed, double-bagged in labeled 6-mil poly bags, and transported to a New York State-permitted landfill. All waste manifests are retained as required by NY DEC.
Clearance Air Testing & ACP-5 Closeout
An independent NY DOL-certified air monitor conducts final air sampling. The area cannot be re-occupied until fiber counts fall below 0.01 f/cc. A closeout certificate is filed with NYC DEP to close the ACP-7 project.
